JUDGMENT

HIS HONOUR: In this matter I dismiss the application and I publish my reasons. I did propose to order that the applicant pay to the respondents, with the exception of the eighth respondent, their costs of and incidental to the application to be assessed on a standard basis. I indicated that would probably happen but I should not make that order, I think, until I have heard from the applicant as to what his attitude is.

HIS HONOUR: I think in the circumstances there is no reason advanced that would justify my departing from the ordinary constraints in the exercise of discretion in relation to ordering an unsuccessful party to pay the costs of the successful one. So I do then make the order I foreshadowed.

I order that the applicant pay to the respondents, with the exception of the eighth respondent, their costs of and incidental to the application to be assessed on the standard basis.
