JUDGMENT

HIS HONOUR: This is an application for the winding-up of the respondent company. The basis of the winding-up is the company's failure to respond to a statutory demand for a judgment debt in the sum of $264,766.88.

I am satisfied that the demand was appropriately served and not complied with. I am informed that the service of this application was made on the registered office of the respondent company, but that the documents have been returned. I am satisfied that the address, at which service was made by post in accordance with the rules, is the registered office of the company. It is the address to which the statutory demand was sent and not returned. In addition to that, the affidavit of Mr Hayward satisfies me that the application was sent to the address of the sole director of the respondent company, and has not been returned.

The application has been duly advertised in accordance with the rules. The Registrar has furnished a certificate to this effect. In all the circumstances, I am satisfied that the company ought to be wound up and I make orders in terms of the draft initialled by me and placed with the papers.
