JUDGMENT

HIS HONOUR: Having considered the submissions on behalf of both parties in respect of the two several applications I have come to the view that each application should be allowed.

In respect of the application made on behalf of the plaintiff I grant leave for the plaintiff to deliver interrogatories on behalf of the plaintiff in the form referred to in the affidavit of Andrew Cummins filed herein on the 26th of June 2003. Such interrogatories are to be answered within 21 days of their being delivered.

In respect of the application made by the defendant I order that the plaintiff provide further and better particulars of the statement of claim pursuant to rule 161 of the Uniform Civil Procedure Rules within the same period allowed for the defendant's answer to the plaintiff's interrogatories.

HIS HONOUR: I direct that the costs of and incidental to both applications be costs in the cause.
