Fassio v Kambah Tea Tree Plantation Pty Ltd

[2005] QSC 97

SUPREME COURT OF QUEENSLAND

CIVIL JURISDICTION

JONES J

No 101 of 2005

CARLO FASSIO AND NEIL VAN WAVEREN

Applicants

and

KAMBAH TEA TREE PLANTATION PTY LTD

Respondent

CAIRNS

DATE 14/04/2005

JUDGMENT

HIS HONOUR: In this matter the applicant seeks to withdraw the application which I am satisfied has been served on the respondent. It appears that the winding-up of the company is no longer able to be undertaken, but the applicant seeks an order for costs. The respondent does not appear to oppose the making of the order for costs or to argue that the application was not properly instituted.

In those circumstances I grant the application for costs and I make orders in terms of the draft initialled by me and placed with the papers.
