JUDGMENT

HIS HONOUR: This is an application on the part of Lorraine Brenda Mackay for the winding up of Gilmac Cairns Pty Ltd on the just and inequitable grounds. The company traded as a pool construction business. It was a joint enterprise between two families - the Gill family and the Mackay family.

It appears, from the material, that the relationship between those two families has irreparably broken down, and that the business of the company has effectively come to a standstill.

In those circumstances, it is appropriate that the company be wound up in the most efficient and fair and final way as possible, and this, I believe, will be achieved by appointing a liquidator, notwithstanding that there are some attendant costs in this process.

The main parties have agreed to that course of action, and in accordance with my discretion, I approve the arrangement that has been agreed between the parties. I make orders by consent in terms of the draft initialled by me, and placed with the papers.
