JUDGMENT

HIS HONOUR: This is an application for the change in the description of the respondent from 3M Pharmaceuticals Pty Ltd to 3M Australia Pty Ltd.

That step is with the consent of the solicitors representing both parties, the original respondent being identified by reason of incorrect information supplied by the former solicitors of that party. In the circumstances and in the light of current information the proceedings ought to be entitled with the correct name of the true respondent.

I will order that the title of the respondent be changed to 3M Australia Pty Ltd.

That change having been made the parties consent to an order that the plaintiff have leave pursuant to section 43 of the Personal Injuries Proceedings Act to issue proceedings against the now correctly titled respondent.

I will make orders in terms of the draft initialled by me and placed with the papers.
