JUDGMENT

HIS HONOUR: This is an application by Hao Sha seeking the winding up of Excel Tour Services Pty Ltd. Mr Sha is a director of that company and he loaned to it the sum of $56,365. He has sought the repayment of that loan, but the loan remains unpaid. He made a statutory demand for the payment of the amount, that demand remains unsatisfied and on that basis the Court deems that the company is insolvent and ought to be wound up.

Messrs Anthony James Johnson and Gerard John Myer of KPMG have agreed to be appointed as liquidators and their appointment will thus be made. I will make orders in terms of the draft initialled by me and placed with the papers.

A similar application was made in the matter of Ikebe and Excel Tour Service Pty Ltd. By reason of the order that I have just made, it is unnecessary to further consider that matter. That application will simply be adjourned to a date to be fixed.
