JUDGMENT

MR. JUSTICE D.M. CAMPBELL: The applicant seeks leave to appeal against a sentence of four years' imprisonment on each of nine charges. The sentences were imposed by Judge Kimmins in the District Court on 3 September 1979 following the applicant pleading guilty to four charges of breaking and entering with intent under section 422 of the Criminal Code, four charges of breaking, entering and stealing under section 421 and one charge of false pretences under section 427. The offences were committed over a period of nine days between 3 and 11 June.

The applicant is 25 years of age. He was married in 1973, and is divorced, and has one child six years of age. His Honour said when sentencing him, “So far as the sentences are concerned, Brough, you were released from gaol on 21 May 1979 and within a period of three weeks you had committed the nine offences to which you have pleaded guilty here.” The sentence he was referring to was a sentence of two and a half years hard labour for breaking entering and stealing. He has convictions for dishonesty extending back to 1972 and has been in gaol on several occasions. In those circumstances it is impossible to say, in my opinion, that the sentences are manifestly excessive.

MR. JUSTICE KNEIPP: I agree.

MR. JUSTICE D.M. CAMPBELL: The appeal is dismissed.
