Reasons for Decision

    On 7 August 2020, the State of Queensland (Queensland Health), pursuant to s 189 of the Industrial Relations Act 2016 ("the Act"), made an application to certify the Aboriginal and Torres Strait Islander Health Workforce (Queensland Health) Certified Agreement (No. 1) 2019 ("the agreement").

    The named parties to the agreement are:
  • State of Queensland (Queensland Health);
  • Together Queensland, Industrial Union of Employees; and
  • The Australian Workers' Union of Employees, Queensland.
  1. [3]
    The agreement is signed by all the abovementioned parties.
  1. [4]
    The agreement applies to the employer party of the agreement listed in cl 3 and its employees for whom classifications and rates of pay are prescribed by the agreement.

    The application is accompanied by a copy of the agreement signed by each party.

    I have had regard to the affidavits of Ms Theresa Hodges, Chief Human Resources Officer, Human Resources Branch, State of Queensland (Queensland Health), filed on 7 August 2020.

    Having regard to these affidavits:
  • I am satisfied of each relevant requirement in ch 4, pt 5, div 2, sub-div 2 of the Act; and
  • there is nothing in the agreement which would require me to refuse to grant the application pursuant to ch 4, pt 5, div 2, sub-div 3 of the Act.

    The application to certify the Aboriginal and Torres Strait Islander Health Workforce (Queensland Health) Certified Agreement (No. 1) 2019 is granted.
  1. [9]
    The Aboriginal and Torres Strait Islander Health Workforce (Queensland Health) Certified Agreement (No. 1) 2019 operates from the day it is certified, namely 13 August 2020.
  1. [10]
    Although the nominal expiry date of the Aboriginal and Torres Strait Islander Health Workforce (Queensland Health) Certified Agreement (No. 1) 2019 is 31 August 2022, it continues to operate until it is terminated under s 227 or s 228 of the Act.

    I make the following order:

The Aboriginal and Torres Strait Islander Health Workforce (Queensland Health) Certified Agreement (No. 1) 2019 is certified.
