Mr Carter convicted of murdering Ms Marke and, on his own plea, of supplying heroin to and aiding suicide of Mr Smyth. These charges arose out of Mr Carter having assisted Ms Marke and Mr Smyth in killing themselves by way of administration of heroin.

Appeal against murder conviction allowed, incompetent representation having engendered a miscarriage of justice; conviction quashed; retrial ordered: McMurdo P, Jerrard JA, Mackenzie J. At the retrial, Mr Carter was again convicted of murder and sentenced to life imprisonment. His attempts to appeal against ([2003] QCA 515; [2005] HCATrans 175) and otherwise revisit ([2012] QSC 234; [2013] QCA 140) the conviction, and reopen the sentence ([2016] QSC 86), were unsuccessful.
