Mr Rose convicted of 6 counts of incest in respect of his de facto stepdaughter who was aged 17 and 18 at the time of the offences.

The court held that, at the time of the offences, Mr Rose and the complainant were ‘entitled to be lawfully married’ within the meaning of Criminal Code (Qld) s 222(8). Accordingly, the court granted Mr Rose an extension of time, allowed the appeal against convictions, quashed the convictions, and entered verdicts of acquittal on all counts: McMurdo P, Muir JA, Atkinson J.
