Appeal against conviction allowed, conviction quashed, retrial ordered. Having suffered from a panic attack and/or pronounced anxiety in the courtroom, Mr Wade’s mental and emotional state was such that his plea of guilty was not free and voluntary, giving rise to a miscarriage of justice: Muir and Chesterman JJA and Wilson AJA. At the retrial, Mr Wade was acquitted of murder but convicted of manslaughter and sentenced by Applegarth J to 9 years' imprisonment.
