Prior to his conviction for drug trafficking, Mr Kashani-Malaki brought proceedings against Mr Di Carlo alleging that (as his barrister) he was negligent in his preparation for his criminal trial. Mr Di Carlo defended on the basis that the subsequent imposition of the sentence of imprisonment on the plaintiff meant that the prosecution of the matter needed to be undertaken by the Public Trustee.
