The Sisters of Mercy challenged the decision of the Queensland Heritage Council to enter a convent into the Heritage Register. A preliminary issue concerned the available grounds for the appeal. Held that the Sisters of Mercy were entitled to include matters concerning whether it was likely the convent needed to be removed and replaced and whether its physical condition and structural integrity prevented preservation of its cultural heritage: Robin QC DCJ.
