The defendant called upon all four guarantees and received payment from the guarantors in full pursuant to a contract with the plaintiff. The defendant claimed to be entitled to damages from the plaintiff for delay. The plaintiff agreed that the defendant was entitled to call on the guarantees but only to the extent of 5% of the contract price and sought to recover the overpayment. Claim dismissed: McMurdo J.
