Appeal against judgment dismissing application for payment under BCIPA; work was within the scope permitted by the licence class but which were outside the restriction; the prohibition in s. 42(1) was confined to persons not holding a contractor's licence of the appropriate class, and did not extend to work done in breach of conditions or exceeding limitations imposed by licences: appeal allowed: Holmes and Muir JJA, Mackenzie AJA.
