HIS HONOUR: This is an application for leave, pursuant to section 43 of the Personal Injuries Proceedings Act 2000, to start proceedings, notwithstanding the non compliance with the provisions of that Act.
This claim arises as a consequence of an accident occurring in East Timor on the 18th of December, the year 2000. As a consequence the applicant's claim must be commenced before 8th of December 2003 and there is not the opportunity in the time remaining for the compliance with the provisions of the Act.
I am satisfied that the terms of the order proposed will achieve the compliance that is necessary before the action, which I give leave to commence, proceeds.
I will make orders in terms of the amended draft initialled by me and placed with the papers.
