EDITOR'S NOTE
The Court considered an appeal by a number of persons convicted of “people smuggling” being the offence created by s 232A of the Migration Act. The offence of bringing persons to Australia (including the facilitating of the bringing of persons to Australia), can be committed even if there is no evidence that the persons actually entered Australia. The offence would also be committed if the intention was to bring the persons to a location off the coast of Australia, with the intent of allowing an Australian ship to take the passengers the rest of the way to Australia.
