The matter before Jackson J concerned the question of the solvency of a company in circumstances where the company is trading profitably but its total liabilities significantly exceed total assets and the company survives only by the grace of certain creditors who have agreed to defer their debts. The decision contains a useful discussion of the question of commercial insolvency and the distinction between balance sheet insolvency and financial insolvency.
