Reasons for Decision

    City Parklands Services Pty Ltd (ABN: 72 068 043 318) ("City Parklands") has made an application to certify an agreement pursuant to s 189 of the Industrial Relations Act 2016 ("the Act").

    As required by s 189(3) of the Act, the application was made within 21 days of the date on which the agreement was signed.

    The parties bound by this agreement are City Parklands, its Employees whose rates of pay are fixed by this Agreement and who are engaged in the classifications provided in Schedule 1 of the proposed certified agreement and the following unions:
  1. (a)
    Construction, Forestry, Mining & Energy, Industrial Union of Employees, Queensland;
  1. (b)
    Plumbers & Gasfitters Employees' Union Queensland, Union of Employees;
  1. (c)
    Queensland Services, Industrial Union of Employees;
  1. (d)
    The Australian Workers' Union of Employees, Queensland;
  1. (e)
    The Electrical Trades Union of Employees Queensland; and
  1. (f)
    United Voice, Industrial Union of Employees, Queensland.

    The agreement has been signed for and by all parties to the agreement.[1]

    On 6 April 2020, the Commission as presently constituted, certified the agreement.
  1. [6]
    In certifying the agreement, the Commission recognises that:[2]
  1. (a)
    each relevant requirement pursuant to Subdivision 2 of Division 2 of Part 5 of the Act has been satisfied;[3] and
  1. (b)
    that there were no matters in the agreement which would require the Commission to refuse to grant the application pursuant to Subdivision 3 of Division 2 of Part 5 of the Act.[4]

[7]  The agreement operates from the day it was certified, namely 6 April 2020.[5] Although the nominal expiry date of the agreement is 31 August 2023, the agreement continues to operate until it is terminated pursuant to ss 227 or 228 of the Act.

[8]  The application to certify the City Parklands Services Certified Agreement 2020 is granted.

[9] I make the following order:

  1. The City Parklands Services Certified Agreement 2020 is certified.
