Primary Judgment[2012] QSC 27712 Sep 2012Mr Dodge was convicted of a number of offences including using the internet to expose a person under the age of 16 years to an indecent matter. The conviction arose by reason of a covert police officer assuming the identity of a 14 year old boy. Mr Dodge contended that the Dangerous Prisoners (Sexual Offenders) Act 2003 did not apply to him because he was not a "prisoner" under the Act. The Court rejected the argument and made orders under the Act: Ann Lyons J.
Appeal Determined (QCA)[2012] QCA 280 (2012) 226 A Crim R 3119 Oct 2012No child was involved in the offence and as such Mr Nudd was not a "prisoner" under the Dangerous Prisoners (Sexual Offenders) Act 2003. Appeal allowed. Orders below set aside: Muir JA, Gotterson JA, Atkinson J.
