REASONS FOR DECISION
- [1]On 15 February 2018, I dismissed the application for review in this matter lodged by Ms Radovic: see Radovic v Treasury Casino Brisbane [2018] QCAT 41.
- [2]On 11 June 2020, Ms Radovic lodged an application for miscellaneous matters, seeking that a non-publication order be made. The reasons Ms Radovic sought a non-publication order were as follows:
The reason I do not want this to be able to be viewed online and accessed so easily is due to the impact this could have on my current or future employment. This matter is a personal matter between me and the Treasury Casino. As I was unable to defend myself in front of the tribunal or have the application time for this matter extended I feel that there is no reason that this needs to remain public. Considering the current environment and work issues related to COVID-19, I am particularly worried about the ramifications this could have on future employment possibilities.
The case also mentions certain aspects of my mental health at the time that I would prefer to keep private.
- [3]Section 66(2) of the Queensland Civil and Administrative Tribunal Act 2009 (Qld) sets out the grounds upon which a non-publication order may be made:
The tribunal may make an order under subsection (1) only if the tribunal considers the order is necessary—
- (a)to avoid interfering with the proper administration of justice; or
- (b)to avoid endangering the physical or mental health or safety of a person; or
- (c)to avoid offending public decency or morality; or
- (d)to avoid the publication of confidential information or information whose publication would be contrary to the public interest; or
- (e)for any other reason in the interests of justice.
- [4]The only grounds which might be relevant to Ms Radovic’s application for a non-publication order are those contained in s 66(2)(b) and (e).
- [5]While I understand Ms Radovic’s desire for privacy regarding her mental health circumstances at the time, she has not claimed that continued publication would endanger her physical or mental health or safety.
- [6]While I also understand Ms Radovic’s concern about the potential impact on her employment, it is fundamental to public confidence in the administration of justice that proceedings in the Tribunal are open and transparent. I am not persuaded that it is in the interests of justice for a non-publication order to be made.
- [7]The application for miscellaneous matters is dismissed.
