The applicant had a sewerage system installed on her property, which proved defective, and brought an application seeking damages against the respondent, the designer of the system. It was found by an adjudicator that the applicant's treatment facility could be lawfully approved by the Local Authority without the prior approval of the system by the Chief Executive of the Department of Natural Resources: K Buxton Adjudicator.
