QCAT having previously terminated Ashworth's residential tenancy on 16 September 2011 ordered that Costello, who was the building owner, pay Ashworth an amount of about $2900.

Costello paid the $2,900 to Ashworth and appealed. The appeal was successful. Leave to appeal was granted and the decision of the Tribunal dated 27 January 2012 was set aside and the application dismissed: Senior Member Oliver.

Costello demanded the $2,900 back from Ashworth. Ashworth refused to pay. Costello sued for monies had and received in the Magistrates Court and obtained summary judgement against Ashworth.
