JUDGMENT
HIS HONOUR: The order of the Court is this. Order that proceedings under the ex officio indictment be stayed until the Crown makes an application pursuant to section 590 for leave to present an indictment beyond the six month limit.
I further order that if the prosecution does not follow that procedure than an application may be made to this Court to permanently stay the ex officio indictment.
I publish my reasons for judgment.
