Barker v Commissioner of Police[2012] QDC 255

Barker v Commissioner of Police[2012] QDC 255

[2012] QDC 255

DISTRICT COURT

APPELLATE JURISDICTION

JUDGE McGINNESS

No 2627 of 2012

ALEX ARTHUR BARKER

Appellant

and

COMMISSIONER OF POLICE

Respondent

BRISBANE

DATE 11/07/2012

ORDER

HER HONOUR: Well, in the circumstances, formally having regard to the fact that the applicant is more than likely to have served his sentence prior to the appeal coming on, and the fact that it is impossible at this stage without the transcript to determine the reasons that a sentence of imprisonment was imposed, and therefore the strength of the applicant's case, I rely on the case of Commissioner of Police v Shane MacDonald [2012] QDC 157, and the comments made by his Honour, Judge McGill, at pages 4-5, and appeal bail will be granted in terms of the draft order, which will be placed on the file.
