Reasons for Decision

    On 16 February 2024, the State of Queensland (Queensland Parliamentary Service) ('the QPS') made an application pursuant to s 189 of the Industrial Relations Act 2016 (Qld) ('the IR Act') to certify the Parliamentary Service Electorate Office Staff Certified Agreement 2023 ('the agreement').

    The named parties to the agreement are the QPS and the following employee organisations:
  • United Workers' Union, Industrial Union of Employees, Queensland (UWUQ); and
  • Together Queensland, Industrial Union of Employees (TQ).

    The agreement is signed by all the above-mentioned parties.
  2. [4]
    The UWUQ and TQ appeared today and consented to the present application.
  3. [5]
    The agreement applies to all employees of the QPS who are employed under s 26AA of the Parliamentary Service Act 1988 working in electorate offices established by Members of Parliament for whom rates of pay, conditions of employment and entitlements are provided for in this agreement.

    However, the agreement does not apply to employees engaged by the Queensland Parliamentary Service employed to perform work solely within the Parliamentary precinct including Parliamentary Policy Officers allocated to Cross Bench members of parliament, and Chief Executives, Senior Executives and Senior Officers of the Queensland Parliamentary Service.

    Having regard to the submissions made by the parties who appeared at the hearing today, as well as the affidavit of Mr Neil John Laurie, the Clerk of the Parliament, filed on 16 February 2024:
  • I am satisfied of each relevant requirement in ch 4 pt 5 div 2 sub-div 2 of the IR Act; and
  • there is nothing in the agreement which would require me to refuse to grant the application pursuant to ch 4 pt 5 div 2 sub-div 3 of the IR Act.

    The application to certify the agreement is granted. The agreement operates from the day it is certified, being today's date, 1 March 2024.

    Although the nominal expiry date of the agreement is 30 June 2026, it continues to operate until it is terminated under either s 227 or s 228 of the IR Act.

    I make the following order:

The Parliamentary Service Electorate Office Staff Certified Agreement 2023 is certified.
