[1] HIS HONOUR: This is an application pursuant to section 106(5) of the Powers of Attorney Act 1998 for the extension of time within which an application for compensation can be made by the estate of Margarete Sugar (deceased). Margarete Sugar died on the 25th of September 2005 at Innisfail. For a claim for compensation to be made on behalf of her estate within the time stipulated by the above section the claim would need to be formulated and made by today or by at the very latest Monday the 27th of March 2006.
[2] I have read the affidavits filed in support of the application and I am satisfied that efforts have been made to assemble the details upon which a claim could be based but that the formulation of the claim is not yet able to be made. That being the case it is appropriate for the time within which the claim to be presented be extended.
[3] HIS HONOUR: The applicants seek to have the time period extended by eight weeks and that additional time seems to me to be reasonable in all he circumstances. I will therefore make orders as follows, that the time within which an application for compensation can be made by the estate in respect of actions said to be made pursuant to the power of attorney dated 7th of January 2003 be extended for a period of eight weeks from today's date.
[4] I make no order as to costs.
