In this matter Jackson J undertakes a careful and informed analysis of the appropriate approach to the interpretation of the BCIPA. Given the essentially commercial nature of the legislation and its impact on freedom of contract, His Honour favoured an approach which gave the words of the statute their natural meaning rather than applying a “liberal” or “beneficial” construction. Applying that construction the services supplied and the goods supplied by a quarry operator for the owner of the quarry, were not services or goods within the scope of BCIPA.
