The matter before Mullins J concerned a gift to a beneficiary who had predeceased the testator. In relation to the disposition in question, it was held that there was no “contrary intention” to displace the anti-lapse provisions of s.33N of the Succession Act. Her Honour also usefully considered whether or not the Court might rectify the will utilizing the broad powers conferred on the Court by s.33 of the Succession Act?
