Dixonbuild was convicted under s.440ZG(a)(iii) Environmental Protection Act 1994 for unlawfully depositing a “proscribed water contaminant” (identified as sand) “at another place” and in a way so that the contaminant “could reasonably be expected to wash, blow, fall or otherwise move into ... a roadside gutter”. The Magistrates Court imposed a fine of $20,000.00.
